EEOC Budget Request Points To Bigger, Data-Driven Enforcement

In its FY 2027 Congressional Budget Justification (CBJ), the EEOC links its funding request to enhanced enforcement capacity—particularly for complex, systemic discrimination matters still in the investigation pipeline. Two requests stand out:

  • Technology: A 15.6% increase to expand data analytics, digital case management, and large scale reviews of employer practices.
  • Litigation: An 8.1% increase in private sector enforcement litigation, including staffing and litigation support.

The CBJ frames these investments as support for high impact matters requiring economists, statisticians, expert testimony, and extensive employer data—not routine charge processing.

What It Means

For private sector employers, the request shows how the EEOC plans to pursue its priorities. More technology would support earlier identification of potential systemic issues in hiring, promotion, compensation, accommodation, and DEI related practices, and help the agency build systemic cases sooner.

More litigation funding and expert support would strengthen the agency’s ability to pursue large-scale matters—particularly where race or sex based impacts are alleged. In short, the EEOC is asking Congress to fund the infrastructure to turn priority investigations into high impact enforcement actions.

What You Should Do

Final funding decisions are months away, but the CBJ signals where the agency wants to invest. Employers should anticipate more detailed information requests in EEOC charge investigations as the agency evaluates systemic potential.
