OFCCP’s Internet Applicant Rule requires federal contractors to keep certain records whenever they search internal or external résumé databases. But do all résumé database searches trigger these special recordkeeping requirements? And does LinkedIn qualify as a “résumé database” when talent acquisition professionals use it to identify potential recruits? This session will lay out all of the key ground rules that apply to résumé database searches and answer some of the trickier questions about modern-day social media recruiting practices.

It’s hard enough trying to stay on top of the compliance requirements established by federal workplace regulators such as the U.S. Department of Labor and Equal Employment Opportunity Commission, to name just two. But over the past several years, an increasing number of state and local governments have established their own rules on recruitment and selection, including by restricting questions employers can ask job seekers, requiring employers to publish salary ranges for each job, and limiting the kinds of tests and technologies employers can use to support their recruitment and selection process. This session will highlight the most important state and local developments affecting talent acquisition, identify what else might be in the works at the state and local level, and offer some practical suggestions for avoiding the legal pitfalls these requirements are creating.

College recruitment programs can take many forms, each of which can trigger unique record-keeping and compliance requirements. This session will examine the most common college and university recruitment practices, identify how they implicate fundamental compliance and recordkeeping requirements, and offer practical guidelines employers can follow to minimize campus recruitment compliance risks.
Time
9:00 AM - 9:50 AM
9:00 AM

OFCCP’s Internet Applicant Rule is the single most important component of the overall TA compliance and risk management framework for federal contractors. And even employers that don’t hold federal contracts can learn from, and apply, its core principles to more effectively manage their TA risks. This session will feature a straightforward overview of the Internet Applicant Rule and explain how each of its four elements can help TA professionals better manage both compliance and risk.
Time
9:00 AM - 9:50 AM
9:00 AM

As more employers emphasize the importance of diversity to their operations, TA professionals face increasing pressure to develop and present “diverse candidate slates” for their hiring managers to consider. And whether those efforts are targeted to women, minorities, veterans, or persons with disabilities, the line between what’s prohibited and permitted can sometimes be difficult to see. This session will identify and explain when and how recruiters can implement effective, and compliant, diverse slate initiatives.
Time
10:00 AM - 10:50 AM
10:00 AM

Like it or not, government agencies such as the EEOC and OFCCP increasingly turn to statistics (and sometimes only to statistics) to support allegations of noncompliance or systemic hiring discrimination. This session will examine the statistical tactics adversaries often use to challenge the fairness of an employer’s recruitment and selection decisions and offer practical suggestions for building stronger data and statistical defenses to these challenges. No calculators or math skills required.
Time
10:00 AM - 10:50 AM
10:00 AM

Standard “adverse impact” analyses of applicant and hire data can tell you only so much about how TA decisions influence an organization’s compliance, D&I, and risk. This session will move beyond these routine analyses by examining some of the more sophisticated ways employers can measure the compliance and diversity-related outcomes of their recruitment and selection practices, and the effects they have on an organization’s broader compliance, risk management, and diversity and inclusion goals.
Time
11:00 AM - 11:50 AM
11:00 AM

Carefully crafted prescreening questions, and thoughtfully designed workflows around them, can go a long way in solving the common problem of getting too many resumes from job seekers who aren’t qualified for or interested in the position you’re trying to fill. This session will explore real-world prescreening techniques that significantly reduce both burden and risk, and offer practical guidance for TA professionals to effectively manage the process, rather than letting the process manage them.
Time
11:00 AM - 11:50 AM
