EEOC Fact Sheet On Discrimination Against American Workers Needn’t Be Posted But Should Be Followed

What's New

The EEOC has released a fact sheet about discrimination against American workers. Many CWC members have asked whether this fact sheet must be posted in the workplace. The short answer is no. While the new fact sheet looks like a workplace poster, employers are not obligated to display it or distribute it. The EEOC only requires posting of the official “Know Your Rights: Workplace Discrimination is Illegal” poster. However, the EEOC plans to revise this poster soon in response to recent policy changes, including Executive Orders 14168 and 14173.

What It Means

Employers must continue to post the required Know Your Rights poster and monitor for updates. The EEOC is not mandating posting of the new fact sheet or recent guidance on DEI-related discrimination. However, these documents signal the EEOC’s enforcement priorities and evolving interpretations of nondiscrimination laws.

What You Should Do

Ensure the Know Your Rights Poster is displayed and be prepared to update it when the EEOC releases a new version. Take the new guidance and fact sheet seriously. Review your organization’s policies and practices to confirm that they align with Title VII and other nondiscrimination laws. Communicate these developments to managers so that everyone understands the latest requirements and expectations.
