Under New E-Verify Status Change Report, Employers Must Monitor Revoked Work Authorizations

What's New

U.S. employers are responsible for ensuring that all their employees are authorized to work in the United States. They typically accomplish this through Form I-9 – and for federal contractors, through E-Verify. Employees may present various documents to prove work authorization, including an Employment Authorization Document (EAD) issued by U.S. Citizenship and Immigration Services (USCIS). EADs allow certain non-citizens to work in the U.S. for a limited period.

Previously, employers received E-Verify Case Alerts when the Department of Homeland Security (DHS) revoked an employee’s EAD. Going forward, these alerts will no longer appear. Instead, employers must generate the new Status Change Report in E-Verify to identify revoked EADs.

What It Means

E-Verify developed a new Status Change Report to help employers determine whether any EADS used to create E-Verify cases have since been revoked. To avoid liability for continuing to employ individuals who lack valid work authorization, employers should regularly access the Status Change Report under the “Reports” tab in E-Verify and promptly reverify work authorization if an employee’s EAD appears as revoked. DHS instructs employers not to create a new E-Verify case during reverification.

Employers should schedule routine checks of the Status Change Report in E-Verify and follow DHS’s EAD Revocation Guidance for E-Verify Employers on reverification timelines and procedures.
