DOL Seeks OMB Approval For National Worker Survey On FLSA Compliance

What's New

The U.S. Department of Labor (DOL) has asked the White House Office of Management and Budget (OMB) to approve a new National Worker Survey. The survey would collect worker-reported data to estimate the prevalence of Fair Labor Standards Act (FLSA) noncompliance, with oversampling in low-wage industries. OMB is accepting public comments on the proposed information collection through April 27, 2026. A draft of the survey is available for download.

What It Means

DOL notes that most Wage and Hour Division (WHD) enforcement actions—about 64 percent—are initiated in response to worker complaints, which may understate violations in industries where workers are less likely to file complaints. To address that limitation, DOL intends to use this survey to generate nationally representative data on FLSA noncompliance, particularly in low-wage sectors. The agency states that the results will help it prioritize enforcement, compliance assistance, and outreach by identifying industries, job characteristics, and pay practices where violations are most prevalent.
