OEWS Report Now Mandatory In Two Additional States

Maryland and Virginia have joined the list of states that require employers to respond to the Bureau of Labor Statistics (BLS) Occupational Employment and Wage Statistics (OEWS) report, which provides employment and wage estimates for 830 occupations in more than 400 industries. The report surveys employers nationwide and produces estimates for states, metropolitan areas, nonmetropolitan areas, the District of Columbia, and selected U.S. territories. BLS partners with state agencies to select employers and collect information.

While federal law does not require employers to participate in the OEWS report, 25 states and the District of Columbia now require employer participation.

What It Means

Employers selected to complete the OEWS report in Maryland, Virginia, or any other jurisdiction where the survey is mandatory must submit the report or risk potential fines. Employers can expect to receive the next round of OEWS reporting requests sometime shortly after May 12, 2026.

What You Should Do

Employers should develop a plan to respond to mandatory OEWS requests.
