CWC Interstate: February 2023 Update

What's New

CWC presents an update of state and local workplace compliance requirements that have occurred since our previous update in December 2022.

What It Means

Some updates relate to discrimination:

  • Minnesota’s amended Human Rights Act expanded the definition of race discrimination to cover traits associated with race, including hair textures and hair styles.
  • South Carolina issued a new anti-discrimination poster that state employers must display.
  • Chicago’s Bodily Autonomy for All ordinance prohibits employers from discriminating against individuals because they received reproductive or gender-affirming health care.

Other updates concern employee leave and breaks:

  • Illinois amended its break requirements to require covered employers to give eligible employees an additional 20-minute break if they work a shift lasting 12 hours or longer.
  • Illinois’s Paid Leave for All Workers Act requires most Illinois employers to give eligible employees up to 40 hours of paid leave per year that can be used for any purpose.
  • San Fransisco approved an ordinance requiring covered employers to provide supplemental compensation to eligible employees working in San Fransisco that take military service leave.

Some states updated pay reporting/transparency requirements:

  • California updated its guidance on the state’s annual pay data reporting requirements for 2023.
  • California’s Equal Pay Act requires employers to post salary range information in job postings.
  • New York passed a law requiring covered employers to display pay information in job postings.
