DOL, OMB Direct Contracting Agencies To Designate Labor Advisors

The Biden Administration issued a memorandum instructing federal contracting agencies to designate one or more labor advisors to guide agency officials on federal contract labor matters. The joint memo, from the White House Office of Management and Budget (OMB) and the Department of Labor (DOL), also announced the formation of a Contract Labor Advisor Group (CLAG) to promote better understanding and implementation of contract labor laws.

The deadline for federal contracting agencies to designate a labor advisor is February 15. Labor advisors will promote understanding of labor law requirements, provide promising practices for obtaining compliance, develop federal workforce training tools, and serve as a liaison to workplace enforcement agencies. Labor advisors must be career employees rather than political appointees, according to the memo. They also must have a working knowledge of contract labor laws and a general understanding of federal acquisition.

CLAG will focus on training about E.O. 14055 and E.O. 14063, using Federal Acquisition Regulations to promote labor peace, and reminding contracting officers about their responsibilities.

What It Means

The OMB/DOL memorandum is a tangible action by the Biden Administration to implement the recommendations of the White House Task Force on Worker Organizing and Empowerment. It signals that the Biden Administration intends to consider a company’s labor law compliance record when awarding federal contracts.
