Supreme Court Preview 2023-2024: Employment Law

What's New

The Supreme Court’s 2023-2024 term includes several employment cases that could significantly affect employers, even if they don’t attract the same attention as last term’s affirmative action ruling.

What It Means

Cases to watch:

  • Muldrow v. St. Louis: Will decide whether a discriminatory job transfer is actionable under Title VII where there is no finding that the transfer decision significantly disadvantaged the employee
  • Acheson Hotels, LLC v. Laufer: Will determine if individuals can sue a public accommodation for failing to provide disability accommodation information online, even when the person has no plan to visit.
  • Murray v. UBS Securities: Will address whether whistleblowers must prove “retaliatory intent,” or whether employers must disprove it.
  • Loper Bright Enterprises v. Raimondo: Will revisit the Chevron doctrine, which gives agencies deference in interpreting statutes.
  • Neal Bissonnette v. LePage Bakeries Park St., LLC: Will determine whether the transportation worker exemption in the Federal Arbitration Act applies only to those working for transportation companies.

What You Should Do
