OFCCP Resumes Processing Section 503 and VEVRAA Complaints But Closes Pending Compliance Reviews

The Office of Federal Contract Compliance Programs (OFCCP) has announced that all pending compliance reviews arising under Section 503 of the Rehabilitation Act (Section 503) and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) will be administratively closed, but the agency will resume processing Section 503 and VEVRAA complaint investigations “as normal.”

The agency’s announcement comes in response to Secretary of Labor Order 08-2025, which lifted the hold Acting Labor Secretary Vincent Micone placed earlier this year on OFCCP enforcement activity. OFCCP also stated that it would take “no further action” related to the Corporate Scheduling Announcement List released in November 2024, and that the agency would not be requiring Section 503 and VEVRAA affirmative action program (AAP) certification at this time.

What It Means

According to OFCCP, contractors whose compliance reviews were held “in abeyance” earlier this year will “promptly receive” an administrative closure letter. In contrast, any contractors whose Section 503 or VEVRAA complaint investigations were pending as of January 24th will be “promptly notified” that the investigation is resuming. The agency also noted it will begin processing new Section 503 and VEVRAA complaints that were filed during the abeyance.

What You Should Do

CWC members should ensure that their Section 503 and VEVRAA AAPs are in place for their current cycle, and that all compliance activities required by OFCCP’s implementing regulations are ongoing. It is common for OFCCP to request documentation on all of the above during complaint investigations.
