Regulatory Agenda Continues Transition In Federal Contractor Compliance

What's New

The Trump Administration's new regulatory agenda includes several initiatives that would continue the unwinding of the federal contractor compliance framework. Key items include final action on OFCCP's proposal to rescind the E.O. 11246 regulations, significant revisions to the agency's Section 503 regulations, and conforming changes to its VEVRAA regulations. The agenda also anticipates Federal Acquisition Regulation (FAR) Council action to implement E.O. 14173 and remove E.O. 11246 references from procurement regulations.

What It Means

The agenda provides additional evidence that federal agencies are continuing to dismantle portions of the longstanding federal contractor compliance framework. Notably, the agenda offers little insight into how agencies intend to implement or enforce newer contractor-related initiatives that are top of mind for many employers.

As a result, many contractors may find themselves in a transition period. Longstanding affirmative action requirements are being revised or eliminated, but the contours of the replacement compliance framework remain unclear. For employers, the challenge may be determining which existing compliance practices continue to provide value as requirements and enforcement priorities evolve.

What You Should Do

Rather than viewing the agenda solely as a list of requirements that may disappear, federal contractors should use this transition period to evaluate compliance strategies. Some practices developed in response to E.O. 11246 requirements may no longer be legally required, but may continue to support risk management, governance, or evolving enforcement priorities. Employers should also monitor agency actions outside the regulatory agenda, as important contractor compliance questions remain unresolved.
