New York Governor Signs Law Requiring Salary Range in Job Postings

What's New

Covered employers in New York state will have to include salary information in job postings beginning in September 2023, under a measure signed by New York Governor Kathy Hochul on December 21, 2022.

The new law will require employers with four or more employees to display pay information in job postings for all positions that can or will be performed, at least in part, in New York.

Covered employers will be required to include on all job postings the salary or salary range that they believe in good faith they will pay for the position. The requirement applies to advertisements for new hires, promotions, or transfer opportunities.

For jobs that are paid solely by commission, employers will have to state that the compensation will be based on commission instead of including salary range information.

The law does not permit individuals to sue for redress. Instead, it allows aggrieved individuals to file complaints with the state’s Labor Commissioner, who can levy civil penalties.

What It Means

With this action, New York joins California, Colorado, Washington, New York City, and a few smaller localities that mandate pay disclosure.
