This back-to-basics session is a must-attend event for all first-time TACS attendees and a valuable refresher for even the most experienced TA professional, compliance practitioner, and in-house employment lawyer. During this fast-paced overview, our staff introduce and define all of the key terms related to TA compliance, from affirmative action to underutilization, including: Job seekers, applicants, candidates, and internet applicants; basic, minimum, and preferred qualifications; affirmative action, diversity, and equal employment opportunity; recruitment and selection “Protected” groups, and diverse candidate slates; underutilization, hiring goals, and benchmarks; job listing, job posting, requisitions, and recordkeeping; steering, statistical significance, step analyses, and adverse impact; and much more. OFCCP’s Internet Applicant Rule is the single most important component of the overall TA compliance and risk management framework for federal contractors. Like it or not, government agencies such as the EEOC and OFCCP increasingly turn to statistics (and sometimes only to statistics) to support allegations of noncompliance or systemic hiring discrimination. This session will examine the statistical tactics adversaries often use to challenge the fairness of an employer’s recruitment and selection decisions and offer practical suggestions for building stronger data and statistical defenses to these challenges. No calculators or math skills required.

OFCCP’s Internet Applicant Rule requires federal contractors to keep certain records whenever they search internal or external résumé databases. But do all résumé database searches trigger these special recordkeeping requirements? And does LinkedIn qualify as a “résumé database” when talent acquisition professionals use it to identify potential recruits? This session will lay out all of the key ground rules that apply to résumé database searches and answer some of the trickier questions about modern-day social media recruiting practices.

Running a meaningful analysis of TA data – whether to assess compliance risk, measure D&I results, or evaluate overall TA performance – almost always requires knowing the answers to three key questions: What happened to each job seeker? At what stage of the process? And why? Dispositions usually provide the answers to these questions, sometimes for the better, but often for the worse. This session will explain how real-world dispositions make or break an employer’s TA analysis and offer practical suggestions for tightening up the “menu” of available dispositions to make them more useful and effective.

When it comes to compliance, recruiters often point out that compliance practitioners and attorneys aren’t the ones who have to use the ATS platform to fill open positions. But compliance practitioners and attorneys do have to rely on the platform’s output to defend the organization’s recruitment and selection decisions, often in the presence of an aggressive workplace regulator, and sometimes before a judge or jury. This session will display, dissect, and describe an effective ATS extract, revealing how what goes into the platform affects the usability and strength of what comes out.

Standard “adverse impact” analyses of applicant and hire data can tell you only so much about how TA decisions influence an organization’s compliance, D&I, and risk. This session will move beyond these routine analyses by examining some of the more sophisticated ways employers can measure the compliance and diversity-related outcomes of their recruitment and selection practices, and the effects they have on an organization’s broader compliance, risk management, and diversity and inclusion goals.

Our virtual summit wraps up with a “roundtable” discussion on how TA professionals, systems managers, and compliance and diversity practitioners are addressing today’s most pressing TA challenges. Which artificial intelligence tools are being implemented with the most success? Are blind résumés helpful in reducing or eliminating early stage selection bias? What steps are employers taking to identify and address unconscious bias? What are the pitfalls when converting to a new ATS, and how can they be avoided?
