NDA and Waiver Requirements

Many state and local jurisdictions have enacted legislation that restrict and/or prohibit the use of settlement agreements, non-disclosure agreements, and separation and severance agreements to require confidentiality of facts associated with allegations of discrimination, sexual harassment, and/or sexual assault. These laws vary, often substantially, from jurisdiction to jurisdiction and often require very specific language and/or time frames for review by parties to such agreements. CWC’s NDA and Waiver Requirements resource lays out the key elements of the current state non-disclosure and waiver laws to help our members navigate their compliance obligations.
